Question 1 - What's my percentage chance 4 success?

Understanding the Home Office Application Process: A Jigsaw Puzzle Analogy

When it comes to different UK visas, it is important to understand that they are not assessed in terms of percentages by the UKVI (UK Visas and Immigration). Instead, the assessment revolves around demonstrating how you meet the immigration rules through the documentation you submit.

To better comprehend this process, let's use an analogy:

"A potential client gets in touch about getting a UK visa for Thai girlfriend, all types of visas regardless if you need a partner visa, family visa or even a specialist worker visa all should be considered as if you are completing a jigsaw puzzle."

Each piece of the jigsaw puzzle represents an application requirement that you must fulfil. The number of puzzle pieces you need to collect depends on the specific visa application type and route you choose. For instance, whither you apply for a student visa, ancestry UK visa, civil partnership visa or skilled worker visa using a certificate of sponsorship, your application documents should demonstrate the specific requirements related to the visa category you are applying under. As you fulfil each eligibility criteria through your documentation, you receive an individual jigsaw puzzle piece that contributes to completing the entire puzzle.

Once you have collected all the pieces and completed the puzzle, only then will you will be granted the types of UK visa you applied for. It's as straightforward as that. This principle applies to all application routes to the UK.

Understanding the jigsaw puzzle analogy can help you grasp the importance of addressing each application requirement and providing the necessary supporting documents. Just like assembling a puzzle, the successful completion of your visa application hinges on collecting all the required pieces. By diligently fulfilling the eligibility criteria and submitting comprehensive documentation, you increase your chances of a favourable outcome.

It is crucial to approach the visa application process with careful attention to detail, ensuring that all necessary documents are included and that they clearly demonstrate your eligibility. Remember, the UKVI assesses applications in a format resembling an audit rather than a traditional examination score. Your application will be evaluated based on the extent to which you have met the specific requirements outlined in the immigration rules.

To ensure a successful visa application, consider seeking professional guidance from our experienced immigration practitioner. He can provide valuable insights and assist you in compiling the necessary documentation to support your case. Navigating the UK visa application process may seem daunting, but with a well-prepared puzzle—where each piece represents a requirement met—you can complete the picture and achieve your goal of obtaining a UK visa.

Question 2 - What types of UK Visa Applications can I submit in the UK if I'm here on a UK Type C Visa i.e. Visitor?

Short answer NONE.

If you are currently in the UK as a visitor, it's important to note that you cannot submit any other types of visa applications from within the UK. The visitor route is specifically granted for temporary stays and does not provide a pathway to switch or apply for other types of UK visa categories while you are in the UK.

Tourist visas can be issued for different durations, such as 6 months, 2 years, 5 years, or 10 years. However, regardless of the duration, you are only permitted to stay in the UK for a maximum of 180 days (approximately six months) within any consecutive calendar year, starting from the date of your first entry.

It's essential to be aware of this restriction and ensure that you comply with the permitted stay duration. Overstaying your visitor visa can have serious consequences and may impact your future immigration prospects.

There are certain exceptions for individuals coming to the UK as medical visitors or academic visitors. If you fall into these categories, it's advisable to seek further information and guidance specific to your circumstances. For more comprehensive details about visitor visas and their requirements, you can refer to my post or consult with me, MYG LTD appointed immigration professional.

Please note that the information provided here is general and may not cover every possible scenario. It's always recommended to seek personalized advice from a qualified immigration practitioner or refer to the official UK government sources for the most up-to-date and accurate information regarding visa applications.

Question 3 - Can I extend my visa if it's expired?

If your visa has expired, the process of extending it is not straightforward and typically depends on your individual circumstances. It's crucial to address this situation promptly and take appropriate action. Here are some general guidelines:

  1. Visa Categories: The possibility of extending an expired visa varies depending on the specific visa category you hold. Some visas may allow for extensions while others may not. It's important to understand the rules and regulations pertaining to your particular visa type.

  2. Duration of Overstay: The length of time you have overstayed beyond the expiration of your visa can impact your ability to apply for an extension. Overstaying for a short period might have different consequences compared to overstaying for an extended duration.

  3. Eligibility Criteria: To apply for a visa extension, you must typically meet certain eligibility criteria, such as having a valid reason for the extension, meeting financial requirements, and fulfilling other specific conditions outlined by the UKVI.

  4. Individual Circumstances: Each case is unique, and the decision on whether you can extend an expired visa depends on various factors. It's advisable to consult with our immigration practitioner who can assess your situation and provide guidance tailored to your specific circumstances.

To address your situation appropriately, I recommend contacting a UK visa lawyer or complete our own contact form. By doing so, you can provide me with more details about your visa status and the reasons for seeking an extension. I will then get in touch with you to discuss your visa application needs and advise you on the best course of action based on your individual circumstances.

Please bear in mind that the information provided here is general in nature and may not cover all possible scenarios.
